Victims of Uninsured Drivers

If you have been involved in an accident involving a motor vehicle, whether as a passenger, pedestrian, cyclist or driver and it was not your fault, then you may be entitled to compensation. However, it may be that the driver is uninsured or cannot be traced.

The rules under MIB Agreements must be strictly followed and they can be complex. We have the expertise and experience to assist you in making a claim through this channel.

In cases where the driver is uninsured, an application can be made to the Motor Insurance Bureau (MIB) for compensation. You may be entitled to compensation for your injuries and subsequent financial losses and in addition, we may be able to claim for the costs incurred in pursuing the claim on your behalf.

In cases where the driver of the vehicle involved in the accident cannot be identified or traced, an application for compensation may be possible. Reporting requirements are strict. If you are involved in an accident with an untraced driver, you must have reported the accident to the police within fourteen days of the incident, or MIB may reject your claim. For claims involving an untraced driver it agrees to accept, MIB pays a contribution towards your legal costs.

If the injury caused to you was caused deliberately by the driver of the vehicle, MIB is not liable to pay compensation. In such cases, a claim may be pursued via CICA (Criminal Injuries Compensation Authority).
