We often assist clients who are unhappy about the way in which a deceased relative’s estate is to be distributed by their will or under intestacy regulations. In such cases, we will look at the circumstances pertaining to the will being challenged and advise on the position and the options.
It may also be that you are unhappy with the way personal representatives and executors are handling the estate. It is not always necessary to go to court. Often matters are resolved by an exchange of correspondence and some brief discussions.
Another common problem is when the will of a deceased person distributes their assets in a way which may seem unfair. Certain people can (regardless of the validity of the will) apply to the court to get a fair share of the deceased person’s estate. These claims are made under the Inheritance (Provision for Family and Dependents) Act.
Property problems can also arise during the handling of a deceased person’s estate, especially when disputes arise over ownership and when the sale of a property by the executor or personal representative could make people homeless.
